1. คำนิยาม1. Definitions

• "บริการ" หมายถึง Kawe AI Gateway รวมถึง API, CLI, และเว็บไซต์ที่เกี่ยวข้อง"Service" means Kawe AI Gateway, including the API, CLI, and related websites.
• "ผู้ใช้" หมายถึง บุคคลหรือนิติบุคคลที่ลงทะเบียนใช้บริการ"User" means any individual or legal entity that registers to use the Service.
• "เครดิต" หมายถึง หน่วยวัดการใช้งานบริการ (≈ 1,000 Tokens ของโมเดลมาตรฐาน อัตราจริงต่างกันตามโมเดล)"Credits" means the unit of measurement for Service usage (≈ 1,000 Tokens on standard models; actual rate varies by model).
• "แผนบริการ" หมายถึง ระดับการใช้งานที่ผู้ใช้เลือก (Free, Starter, Plus, Pro)"Plan" means the usage tier selected by the User (Free, Starter, Plus, Pro).
• "เนื้อหา" หมายถึง ข้อความ, คำสั่ง, และข้อมูลที่ผู้ใช้ส่งผ่านบริการ"Content" means text, prompts, and data submitted by the User through the Service.
• "ผลลัพธ์" หมายถึง คำตอบที่สร้างโดย AI ผ่านบริการ"Output" means responses generated by AI through the Service.

2. การยอมรับข้อตกลง2. Acceptance of Terms

การลงทะเบียน, เข้าสู่ระบบ, หรือใช้บริการ ถือว่าท่านยอมรับข้อตกลงฉบับนี้และนโยบายความเป็นส่วนตัวของเรา หากท่านไม่ยอมรับ กรุณาหยุดใช้บริการBy registering, logging in, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please stop using the Service.

3. บัญชีผู้ใช้3. User Account

3.1 การลงทะเบียน3.1 Registration

• ท่านต้องให้ข้อมูลที่ถูกต้องและเป็นปัจจุบันYou must provide accurate and up-to-date information.
• หนึ่งบุคคลหนึ่งบัญชี (ห้ามสร้างบัญชีซ้ำ)One person, one account (duplicate accounts are prohibited).
• ท่านต้องมีอายุ 18 ปีขึ้นไป หรือได้รับความยินยอมจากผู้ปกครองYou must be at least 18 years old or have parental consent.

3.2 ความปลอดภัยของบัญชี3.2 Account Security

• ท่านรับผิดชอบในการรักษาความลับของรหัสผ่านและ API KeyYou are responsible for keeping your password and API Key confidential.
• ท่านต้องแจ้งเราทันทีหากพบการใช้งานโดยไม่ได้รับอนุญาตYou must notify us immediately if you discover any unauthorized use.
• เราไม่รับผิดชอบต่อความเสียหายจากการที่ท่านไม่รักษาความปลอดภัยของบัญชีWe are not liable for damages resulting from your failure to secure your account.

3.3 การระงับและยกเลิกบัญชี3.3 Account Suspension and Termination

เราอาจระงับหรือยกเลิกบัญชีของท่านหาก:We may suspend or terminate your account if you:

• ละเมิดข้อตกลงนี้Violate these Terms.
• ใช้บริการในทางที่ผิดกฎหมายUse the Service for illegal purposes.
• ไม่ชำระค่าบริการตามกำหนดFail to pay service fees on time.
• ไม่มีการใช้งานเกิน 12 เดือนHave no activity for more than 12 months.

• ≈ 1 เครดิต = 1,000 Tokens ของโมเดลมาตรฐาน อัตราจริงต่างกันตามโมเดล≈ 1 Credit = 1,000 Tokens on standard models; actual rate varies by model.
• ค่าใช้จ่ายต่อคำขอขึ้นอยู่กับโมเดลที่ใช้ (ตัวคูณแตกต่างกัน)Cost per request depends on the model used (multipliers vary).
• เครดิตจะรีเซ็ตทุกรอบบิลลิ่ง (รายเดือน)Credits reset every billing cycle (monthly).
• เครดิตที่ไม่ได้ใช้จะไม่สะสมไปเดือนถัดไปUnused credits do not roll over to the next month.
• เครดิตไม่สามารถโอนหรือแลกเปลี่ยนเป็นเงินสดได้Credits are non-transferable and non-refundable.

4.3 ขีดจำกัดการใช้งาน4.3 Usage Limits

แต่ละแผนมีขีดจำกัด: Rate Limit, Concurrent Limit, Session สูงสุด, API Key สูงสุดEach plan has limits: Rate Limit, Concurrent Limit, maximum Sessions, and maximum API Keys.

4.4 การเปลี่ยนแผน4.4 Plan Changes

• อัปเกรดมีผลทันทีUpgrades take effect immediately.
• ระบบไม่รองรับการดาวน์เกรดแผนอัตโนมัติ หากต้องการดาวน์เกรด กรุณาติดต่อทีมงานAutomatic plan downgrades are not supported. To downgrade, please contact our team.
• ไม่มีการคืนเงินสำหรับเครดิตที่ใช้ไปแล้วNo refunds for credits already consumed.

5. การใช้งานที่ยอมรับได้ (Acceptable Use)5. Acceptable Use

5.1 สามารถใช้เพื่อ5.1 Permitted Uses

• พัฒนาแอปพลิเคชันApplication development.
• วิจัยและพัฒนาResearch and development.
• ใช้งานส่วนตัวหรือเชิงพาณิชย์Personal or commercial use.
• สร้างเนื้อหาที่ถูกกฎหมายCreating lawful content.

5.2 ห้ามใช้เพื่อ5.2 Prohibited Uses

• สร้างเนื้อหาที่ผิดกฎหมายCreating illegal content.
• สร้างมัลแวร์หรือซอฟต์แวร์อันตรายCreating malware or malicious software.
• ละเมิดทรัพย์สินทางปัญญาของผู้อื่นInfringing on the intellectual property of others.
• แอบอ้างเป็นบุคคลอื่นImpersonating another person.
• ส่งสแปมหรือข้อความไม่พึงประสงค์Sending spam or unsolicited messages.
• เข้าถึงระบบโดยไม่ได้รับอนุญาตUnauthorized access to systems.
• หลีกเลี่ยงระบบรักษาความปลอดภัยCircumventing security systems.
• แชร์ API Key กับบุคคลอื่นSharing your API Key with others.
• ทำให้ระบบเสียหายหรือหยุดทำงานCausing system damage or disruption.
• สร้างเนื้อหาทารุณกรรมเด็กCreating child exploitation content.
• สร้างข้อมูลเกี่ยวกับอาวุธหรือสารเคมีอันตรายCreating information about weapons or hazardous chemicals.

5.3 การกรองเนื้อหา5.3 Content Filtering

• ระบบกรองเนื้อหาอัตโนมัติAutomated content filtering.
• ปฏิเสธคำขอที่ไม่เหมาะสมRejection of inappropriate requests.
• กรอง PII (ข้อมูลส่วนบุคคล)PII (Personally Identifiable Information) filtering.
• กรองชื่อแบรนด์Brand name filtering.

6. ทรัพย์สินทางปัญญา6. Intellectual Property

6.1 เนื้อหาของท่าน6.1 Your Content

เนื้อหาที่ท่านส่งผ่านบริการเป็นของท่าน เราไม่นำไปใช้ฝึกโมเดล AIContent you submit through the Service belongs to you. We do not use it to train AI models.

6.2 ผลลัพธ์ AI6.2 AI Output

ผลลัพธ์ที่สร้างโดย AI ผ่านบริการเป็นของท่าน ท่านรับผิดชอบในการตรวจสอบความถูกต้องก่อนนำไปใช้AI-generated output through the Service belongs to you. You are responsible for verifying its accuracy before use.

6.3 แบรนด์ Kawe AI6.3 Kawe AI Brand

ชื่อ โลโก้ และเครื่องหมายการค้า Kawe AI เป็นทรัพย์สินของเราThe name, logo, and trademarks of Kawe AI are our property.

7. ข้อจำกัดความรับผิด7. Limitation of Liability

7.1 บริการ "ตามสภาพ" (As-Is)7.1 Service "As-Is"

บริการให้ "ตามสภาพ" โดยไม่รับประกัน uptime หรือความถูกต้องของผลลัพธ์The Service is provided "as-is" without warranty of uptime or accuracy of output.

7.2 ขอบเขตความรับผิด7.2 Scope of Liability

ความรับผิดสูงสุดไม่เกินค่าบริการรายเดือนล่าสุดที่ท่านชำระ หรือ 5,000 บาท แล้วแต่จำนวนใดจะน้อยกว่าMaximum liability shall not exceed the most recent monthly service fee you paid, or 5,000 THB, whichever is less.

7.3 ความเสียหายทางอ้อม7.3 Indirect Damages

เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายพิเศษ หรือความเสียหายที่เป็นผลสืบเนื่องWe are not liable for indirect, special, or consequential damages.

8. ความพร้อมใช้งาน8. Availability

เราพยายามอย่างเต็มที่เพื่อให้บริการพร้อมใช้งานตลอดเวลา อย่างไรก็ตาม เนื่องจากบริการของเราเชื่อมต่อกับผู้ให้บริการ AI ภายนอกหลายราย (เช่น OpenAI, Anthropic, Google) เราจึงไม่สามารถรับประกัน uptime ได้We make every effort to keep the Service available at all times. However, as our Service connects to multiple external AI providers (e.g., OpenAI, Anthropic, Google), we cannot guarantee uptime.

9. การชำระเงิน9. Payment

• เรียกเก็บรายเดือน สกุลเงินบาท (THB) รวม VATBilled monthly in Thai Baht (THB), inclusive of VAT.
• หากไม่ชำระค่าบริการตามกำหนด บัญชีจะถูกลดเป็นแผน FreeIf payment is not made on time, the account will be downgraded to the Free plan.
• ไม่มีการคืนเงินสำหรับเครดิตที่ใช้ไปแล้วNo refunds for credits already consumed.

10. การเปลี่ยนแปลงข้อตกลง10. Changes to Terms

เราอาจเปลี่ยนแปลงข้อตกลงนี้ได้ โดยจะแจ้งให้ท่านทราบล่วงหน้าอย่างน้อย 30 วัน ผ่านอีเมลและเว็บไซต์We may modify these Terms with at least 30 days' prior notice via email and our website.

11. การยกเลิกบริการ11. Termination

• ผู้ใช้สามารถยกเลิกบัญชีได้ตลอดเวลาโดยส่งอีเมลมาที่ [email protected]Users may cancel their account at any time by emailing [email protected].
• หากเราต้องยกเลิกบริการ จะแจ้งล่วงหน้าอย่างน้อย 30 วันIf we need to discontinue the Service, we will provide at least 30 days' notice.

12. กฎหมายที่ใช้บังคับ12. Governing Law

ข้อตกลงนี้อยู่ภายใต้กฎหมายไทย ข้อพิพาทใดๆ จะอยู่ในเขตอำนาจของศาลไทยThese Terms are governed by Thai law. Any disputes shall be subject to the jurisdiction of Thai courts.
